Welcome to Elite Motorworks Ltd! These Terms of Service (“Agreement”) govern the use of our mobile mechanics services provided in Cheltenham, Gloucestershire, and surrounding areas. By using our services, you agree to the terms outlined below. Please read them carefully.
1. Introduction
Elite Motorworks Ltd (“we,” “us,” or “our”) provides mobile vehicle diagnostics, repairs, maintenance, and restoration services for performance and prestige vehicles, as well as general vehicles. This Agreement is legally binding and complies with the laws of England and Wales.
2. Scope of Services
2.1 Services Provided
Elite Motorworks Ltd offers mobile services, including diagnostics, repairs, maintenance, pre-purchase inspections, restoration, and related parts and supplies sourcing. Services are subject to availability and feasibility at the chosen location.
2.2 Booking Appointments
Services must be pre-scheduled and confirmed electronically or in writing. We reserve the right to decline service requests due to safety concerns, unsuitable locations, or regulatory issues.
2.3 Estimates
We provide cost estimates based on your description of the issue. Estimates may be adjusted following initial diagnostics or unforeseen complications.
3. Client Responsibilities
3.1 Accurate Information
You must provide accurate vehicle details, disclose any known issues, and approve cost estimates before work begins.
3.2 Safe and Accessible Work Location
You must ensure the service location is safe, accessible, and compliant with local regulations.
3.3 Payment Obligations
Full payment is due upon service completion unless otherwise agreed in writing. Accepted payment methods include bank transfer, credit/debit card, or cash.
4. Cancellation and Rescheduling
4.1 Client-Initiated Changes
Cancellations or rescheduling requests must be made at least 24 hours in advance. Late cancellations may incur a fee of up to 50% of the estimated cost.
4.2 Company-Initiated Changes
We may reschedule services due to unforeseen circumstances like weather, safety concerns, or unavailability of parts. In such cases, we will inform you promptly and rebook at a mutually convenient time.
5. Warranty and Liability
5.1 Warranty
We offer a 12-month or 12,000-mile warranty on parts and labour provided directly by Elite Motorworks Ltd. Warranty claims must be made within this period and may require vehicle inspection.
5.2 Exclusions
The warranty does not cover wear and tear, improper vehicle use, misuse, third-party parts, or modifications.
5.3 Client-Supplied Parts
We do not provide warranties for parts supplied by clients and are not liable for failures resulting from their use.
5.4 Liability Limitation
Our liability is limited to the service cost. Elite Motorworks Ltd is not responsible for indirect or consequential damages.
6. Additional Costs
6.1 Travel Costs
For service locations beyond a 20-mile radius of GL51 0PT, additional travel costs of £2 per mile apply.
6.2 Collection and Delivery
Vehicle collection or delivery services are available at £2.25 per mile. You are responsible for ensuring adequate insurance during transport.
7. Service Guarantees
We are committed to completing repairs to the highest standard. If any issues arise, we will correct them at no additional charge or provide partial refunds, as agreed.
8. Payment Terms
8.1 Prepayments for High-Cost Repairs
For parts or services exceeding £500, prepayment may be required.
8.2 Progress Payments
Long-term repairs or restoration projects may require monthly progress payments.
8.3 Late Payments
Unpaid balances after 30 days will incur an 8% interest plus the Bank of England’s base rate, calculated daily, alongside an £85 administrative fee.
9. Data Privacy
9.1 Data Collection
We collect and store personal data (e.g., name, contact information, and vehicle details) solely for service provision.
9.2 Data Security
We comply with GDPR regulations and will not share your information without consent unless required by law.
10. Marketing and Media Usage
10.1 Photos and Videos
We may use images or videos of vehicles serviced for marketing purposes unless you explicitly request otherwise in writing.
10.2 Logo Usage
With your approval, we may use your logo or brand name in promotional materials.
11. Dispute Resolution
11.1 Complaints
Please contact us within seven days of service completion for any concerns. We aim to resolve disputes amicably and efficiently.
11.2 Governing Law
This Agreement is governed by the laws of England and Wales. Disputes will be resolved through UK courts.
12. Termination
Either party may terminate this agreement with written notice if the other fails to meet their obligations.
